GENERAL TERMS AND CONDITIONS


General

These General Terms and Conditions apply to all memberships, purchases, reservations, agreements, and the use of the services and facilities of THE SYSTM®, operated by SYSTM BV, Pontstraat 38/1, 9831 Sint-Martens-Latem, company number BE 1035.810.243 ("we", "THE SYSTM®"). By concluding a membership, placing an order, making a booking, or otherwise using our services, you ("Customer") accept these Terms. If you do not agree, we ask you not to use our services.

Definitions

  • "Services": all measurement, protocol, therapy, coaching, and membership services offered by THE SYSTM®.
  • "Products": items sold through our webshop (e.g. THE SYSTM® Optimization Box).
  • "Membership": the contractual arrangement that grants access to certain facilities and/or Services of THE SYSTM®.

Formation of the agreement

Our offers are non-binding and subject to availability. An agreement is formed as soon as we confirm your registration or booking, receive a payment, or commence the provision of services.

Admission requirements and health screening

Our therapies are intended for adults whose health condition is compatible with the activity involved. Before your first session with HBOT, IHHT, EMS, infrared/sauna or strength training, you must complete our health questionnaire and sign the Waiver & Informed Consent form. We may refuse or adjust a Service if a disclosed condition makes it unsuitable. You are responsible for assessing your medical suitability for our Services; consult a doctor in advance if in doubt.

Membership

Memberships are strictly personal and non-transferable, unless we give prior written consent. Memberships run for the period chosen at registration (monthly or annually) and are automatically renewed for the same period, unless cancelled with a notice period of at least 30 days before the renewal date. 

Prices, payment and cancellation

All prices are quoted in EUR, including VAT unless stated otherwise. Online booked and paid sessions are non-refundable, but can be rebooked or offset against another Service of THE SYSTM® at any time. Appointments can be rescheduled or cancelled free of charge up to 24 hours before the scheduled time; in case of late cancellation or no-show, the full session price may be charged. In case of late payment, we reserve the right to temporarily suspend access to facilities or Services.

Right of withdrawal (distance selling)

When purchasing at a distance (online) as a consumer, a right of withdrawal of 14 days applies in principle according to Belgian and European law. This right expires as soon as a Service has been fully performed with your prior explicit consent and acknowledgment that you lose this right as a result, and, as far as legally permitted, for clearly personalised protocols.

Products via our webshop

Product descriptions, prices and availability are as stated on the website at the time of order. Delivery usually occurs within 5 to 15 working days. Products can be returned in their original condition within 14 days, in accordance with Belgian consumer protection legislation. 

Use of facilities and services

Customers must always follow the house rules, safety instructions and directions from staff. We may refuse access or terminate a membership for inappropriate, dangerous or disruptive behaviour, or for violation of these Terms. Participation in any activity is at the Customer's own risk, subject to Article 11 regarding liability.

Complaints and service level

Complaints about facilities, Services or Products must be reported to us in writing within three (3) working days of identification. Our Services are provided on the basis of a best efforts commitment; THE SYSTM® does not guarantee specific results.

Liability

THE SYSTM® is only liable for direct damage resulting from intentional misconduct or gross negligence by THE SYSTM® or its employees. THE SYSTM® is not liable for bodily injury resulting from participation in an activity for which the Customer is personally responsible, nor for loss, damage or theft of personal belongings, unless there is intentional misconduct or gross negligence. Indirect damage, consequential damage, lost income and moral damage are excluded. Any liability claim will expire if it is not submitted in writing to THE SYSTM® within one (1) year after the damage event. Nothing in this article excludes or limits liability to the extent that this is not permitted under Belgian law, including liability for bodily injury caused by our fault (Book 6 of the Belgian Civil Code).

Our Services support objectives in the areas of performance, well-being and longevity. They do not replace diagnosis, treatment or advice from a qualified physician. Always consult your doctor before starting a new programme, particularly if you have an existing medical condition. See the Waiver & Informed Consent form for the specific risks associated with our therapies.

Intellectual property

All programmes, materials, methodologies, visual elements and branding of THE SYSTM® are protected by intellectual property rights and remain the property of SYSTM BV. The Customer is not permitted to copy, reproduce, distribute or commercially use this material without our prior written consent.

Privacy

We process personal data in accordance with Belgian legislation and the GDPR. By using our Services, you consent to the processing of your personal data as described in our Privacy Policy.

Force Majeure

We are not liable for the non-fulfilment or delayed fulfilment of our obligations due to circumstances beyond our reasonable control, including government measures, strikes, technical failures, natural disasters or pandemics.

Applicable law and competent court

These Terms are exclusively governed by Belgian law. The courts of the judicial district of East Flanders, division of Ghent, have exclusive jurisdiction for all disputes.

Changes

We may change these Terms at any time. Changes will be communicated via email. Continued use of our Services after a change constitutes acceptance of the new Terms.
